1. Description of Service

Persona Builder is an AI-powered software-as-a-service (SaaS) application that generates customer persona profiles from uploaded business data. The Service uses Anthropic's Claude AI to analyze uploaded files and reviews, identify behavioral patterns, and produce structured persona artifacts including journey maps, touchpoints, and insights.

2. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription Tiers and Payment

The Service offers a 14-day free trial followed by a paid Pro plan:

Billing

Pro subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize us to charge your payment method on each billing cycle.

Free Trial

New accounts receive a 14-day free trial with limited features (2 personas, 5MB uploads). After the trial period ends, access to the Service is paused until you upgrade to a paid plan. Your data is preserved during this time.

Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. You will retain Pro access until the period ends.

Refunds

Subscription fees are non-refundable except where required by applicable law. If you believe you are entitled to a refund, contact us at support@persona-builder.com.

Price Changes

We may change subscription pricing with 30 days' notice. Price changes apply at the next billing cycle after the notice period.

4. Acceptable Use

You agree to use the Service only for lawful business purposes. You must NOT:

• Upload personally identifiable information (PII). You must not upload files or enter reviews containing real customer names, email addresses, phone numbers, physical addresses, government IDs, financial account numbers, health information, or any data that could identify a specific individual.
• Upload data you don't have rights to use. You must have the legal right to use any data you upload for the purpose of persona generation.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Use the Service to generate harmful, discriminatory, or misleading content.
• Circumvent usage limits or access features beyond your subscription tier.
• Share account credentials or allow unauthorized third parties to access your account.
• Use automated means (bots, scrapers) to access the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate this section without notice or refund.

5. Your Data and Content

Ownership

You retain ownership of all data you upload and all personas generated from your data. We do not claim ownership of your content.

License to Us

By uploading data, you grant us a limited, non-exclusive license to process, store, and transmit your data solely for the purpose of providing the Service—including sending data to third-party AI providers (Anthropic) for processing. This license terminates when you delete your data or close your account.

No PII Warranty

By uploading data, you represent and warrant that it does not contain personally identifiable information and that you have the right to use it for persona generation. You are solely responsible for ensuring your uploaded data complies with all applicable privacy laws.

Data Deletion

You may delete individual personas, reviews, and generated content at any time. Upon account closure, we will delete your data within 30 days.

Inactive Accounts

Accounts that have been inactive for more than 90 days (no logins or API activity) are subject to deletion. We will attempt to notify you by email at least 14 days before deleting an inactive account. Once deleted, your data cannot be recovered.

6. AI-Generated Content

The Service uses Anthropic's Claude AI to generate persona profiles, behavioral insights, journey maps, and synthetic reviews. You acknowledge that:

• AI output is not guaranteed to be accurate. Generated personas are based on pattern recognition and may contain errors, biases, or inaccuracies. You should validate AI-generated content before making business decisions based on it.
• AI output may not be unique. Similar inputs may produce similar outputs for different users.
• We do not guarantee specific results. The quality and usefulness of generated personas depends on the quality and quantity of your input data.
• AI Research content is synthetic. Reviews generated by the AI Research feature are fictional and should not be represented as real customer feedback.

7. Shared Persona Links

The Service allows you to generate shareable URLs for persona profiles. Shared links are accessible without authentication. You are responsible for:

• Controlling who you share links with
• Ensuring shared personas do not contain sensitive or confidential information
• Understanding that anyone with the link can view the persona

8. Third-Party Services

The Service relies on third-party providers including Anthropic (AI processing), Stripe (payments), Vercel (hosting), Neon (database), Resend (email), and Cloudflare (bot protection). We are not responsible for the availability, performance, or policies of these third-party services. Your use of the Service is also subject to the terms and policies of these providers.

9. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated content will be accurate, complete, or suitable for any particular purpose
• The Service will meet your specific requirements

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your violation of these Terms
• Your upload of data containing PII or data you did not have rights to use
• Your misuse of AI-generated content
• Your violation of any applicable law

13. Termination

By You

You may close your account at any time by contacting us. Active subscriptions should be canceled through the Stripe Customer Portal before account closure.

By Us

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or at our discretion with reasonable notice. Upon termination for cause, no refund is owed.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account closure.

14. Changes to These Terms

We may modify these Terms at any time. We will notify registered users of material changes via email or in-app notice at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Oregon.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
